The Municipal Freedom of Information and Protection of Privacy Act 

The Municipal Freedom of Information and Protection of Privacy Act is Provincial legislation that provides a right of access to information held by a municipal government.

The Act requires municipalities to protect personal information contained in their records by imposing protection of privacy requirements governing their proper collection, retention, use, disclosure and disposal.

The Act is not necessary to access information that is already available to the public

The Director of Council Services/Clerk, is the Freedom of Information and Privacy Coordinator for the Town of LaSalle (Information Coordinator) and is responsible for the administration of the Act, including receiving and processing access requests on behalf of the Municipality and ensuring that the privacy requirements of the Act are met.

How to make a Request for Access

If a member of the public wishes to make a request under the Act, the Request must be made in writing and submitted with the appropriate fee to the Director of Council Services/Clerk.  A requester should always make a general inquiry by contacting the corresponding department and simply asking for the desired information before making a request under the Act.  Should the information not be available, then a formal request for the information under the Act can be made.

Below is a Request Form that may be used or by sending a letter to the Information Coordinator noting in the letter that the request is being made under the Act and detail as much information about the request as possible.  Both the Request Form or Letter must be accompanied by the $5.00 fee required.  Requests will not be processed and the 30 day timeframe for response will not commence until the $5.00 fee associated with the request has been received.

There are mandatory and discretionary exemptions under the Act and such information will not be available.

Right to Appeal Decision

A requester has the right to appeal any decision made by the Information Coordinator by filing an Appeal with the Information and Privacy Commission of Ontario, thirty (30) days after the decision has been made.  The Commissioner must be sent a copy of the original request for information that was sent to the Municipality, together with the Municipality’s decision to deny the request and the appropriate fee.
